I Agreement
This End User License Agreement (“EULA”) is a legal agreement between you and PrayerfulRosary (“we,” “us,” or “our”) governing your use of the Prayerful Rosary application, together with all related content, audio, and updates (the “App”). By downloading or using the App, you agree to this EULA. This EULA is concluded between you and PrayerfulRosary only, and not with Apple; PrayerfulRosary, not Apple, is solely responsible for the App and its content.
II Scope of License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. You may not rent, lease, lend, sell, redistribute, or sublicense the App. You may not copy (except as expressly permitted), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, except to the extent applicable law expressly permits. This license does not allow you to use the App on any device you do not own or control.
III Subscriptions & In-App Purchases
The App offers an optional auto-renewing Premium subscription (monthly or yearly, which may include a free trial) and a one-time lifetime purchase. Subscriptions are billed to your Apple Account and renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel a subscription anytime in your Apple Account settings under Subscriptions. All payments, billing, and refunds are handled by Apple. IV Your Content & Conduct
Any name you enter, journal entries, and prayer intentions are stored only on your device and remain yours. You agree to use the App lawfully and for personal, devotional use, and not to misuse, disrupt, interfere with, or tamper with the App or its security.
V Intellectual Property
The App and its original content — including its design, prayer audio recordings, ambient soundscapes, and text — are owned by PrayerfulRosary and protected by copyright and other laws. Scripture, liturgical, and devotional sources are credited within About & Credits. All rights not expressly granted to you are reserved.
VI Maintenance and Support
PrayerfulRosary is solely responsible for providing any maintenance and support services for the App, as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
VII Warranty
The App is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) you paid for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of PrayerfulRosary.
VIII Product Claims
PrayerfulRosary, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
IX Intellectual Property Claims
In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, PrayerfulRosary, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
X Limitation of Liability
To the maximum extent permitted by law, PrayerfulRosary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of, or inability to use, the App.
XI Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
XII Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
XIII Termination
This license is effective until terminated by you or by PrayerfulRosary. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must stop all use of the App and delete all copies. You may terminate this EULA at any time by deleting the App from your devices.
XIV Changes to This EULA
We may update this EULA from time to time. The current version will always be available here, and within the app, with a revised effective date. Continued use of the App after changes take effect means you accept the updated EULA.
